The following Terms & Conditions apply to all users of this website and signify acknowledgment and acceptance of them. Only those people, businesses, or entities who can legally bind contracts under Indian law may use the Services. By publishing the updated version of these Terms of Use on this website, ETravelMitra may change them at any moment. The revised version will automatically become operative once posted on this website.

Definition Clause

The User(s): For the purposes of this Agreement, a "User" means any individual who accesses the Site for any reason, whether or not such individual has registered as a registered User with ETravelMitra or whether such individual is a paying User for a particular service offered by us. The individual using this site and any legal entity that person may represent with actual or apparent power are both considered Users.

Unauthorized Member / User: Any person who accesses the services without having the necessary legal or contractual authorization will be considered an "unauthorized customer" and will be bound by the terms and conditions, specifically with regard to protecting the provider's intellectual property rights and complying with licensing terms and conditions.

Free Services: Any individual or organization that registers on the website just with the goal of adding their listing and promoting their business online without using any specialist services in connection therewith.

Paid Services- All Users are given free access to the Site and some of its features. In addition to any terms and conditions that may be applicable to a particular Paid Service, this Agreement also applies to all Paid Services (as defined below). However, in the event of any conflict or inconsistency between any provision of the terms and conditions that may apply to a particular Paid Service and any provision of this Agreement, such conflict or inconsistency shall (unless otherwise expressly provided or agreed) be resolved in a manner that favors the party that is entitled to the benefit of the inconsistency

ETravelMitra can amend this Agreement at any time by posting the new amendment and restating the Agreement on the site. The restated and modified Agreement will take effect as soon as it is posted. Your continued use of the Site after ETravelMitra posts the modified and restated Agreement will be taken as your acceptance of the changes. Other than in writing and only by an authorized officer of (ETravelMitra), this Agreement may not be changed in any other way.

Users should be aware that a third party owns the servers, and access to the services is dependent on their availability as they can occasionally be interrupted by hackers or technical issues. ETravelMitra, or the parent company, is not liable for any costs, damages, or extensions of the activation period for these reasons in any way, under any conditions. Users are recommended to save emails, etc. elsewhere and take them offline to prevent technical issues or hacking.

The membership charges are subject to revision and are at the discretion of ETravelMitra.

The User shall not have any claim or right against the Site under any circumstances. The Site maintains the right to prohibit or delete the webpage at any time without providing a reason, etc.

Users consent to receiving communications (through calls, chat, emails, or SMS) on the phone numbers provided during registration or later via registration forms, posting requirements, feedback forms, or any other form that asks for a phone number or mobile number, regardless of whether the number is registered on the Do Not Call Registry, with regard to the subscribed services of Ethics Travel Management Pvt Ltd.

The Site maintains the right to incorporate comments and evaluations from visitors who have used your services. The Agents consent to having their profiles published with these reviews.

User’s Obligations

• The User acknowledges and agrees that in order to use the Service, the User is entirely responsible for the correctness and completeness of the Registration Data and other information submitted to the Company in the Membership application.
• The User shall ensure that the information provided to (Company Name) is accurate and free from any fraudulent, inaccurate, misleading, or otherwise altered facts.
• Before publishing any information on the Site, including but not limited to listing information, tour descriptions, images, maps, layouts, contact information, etc., the User agrees to have obtained all required rights and authorizations.
• All necessary hardware required to access the Service must be configured or set up by the User.
• The User agrees to follow any notifications or instructions the Company may issue from time to time about the usage of the Service.
• All information that the User retrieves, stores, or transmits through the Service is his exclusive responsibility.
• The confidentiality of the login information is the exclusive responsibility of the User.
• The User's username and password, as well as all of the User's actions and transmissions at (Company Name).
• Any unauthorized use of the User's account or any other security breach that the User becomes aware of must be reported to the Company right away.
• The User will immediately pay the Subscription Fees as requested from time to time by the Company.
• If you decide to end your relationship with us, delisting your account from your folder will allow you to unsubscribe or remove your account.

Proprietary Rights in Content on ETravelMitra

Both the site and the services are owned by and remain the property of ETravelMitra. The Site includes trademarks, copyrighted content, and other exclusive information owned by ETravelMitra. Any such proprietary information may not be copied, modified, published, transmitted, distributed, performed, displayed, or sold, with the exception of information that is in the public domain or for which you have been granted authorization.

Intellectual Property Rights

All trademarks, registered trademarks, and logos (collectively, "Marks") used in (Company Name) are either owned by the Company and/or its affiliates or are used with their permission. Intellectual property rights and all other rights arising from them, whether statutory or otherwise, fully vested in the Company and its affiliates. All rights not otherwise claimed by the Company or its affiliates under this Agreement are hereby reserved.

The use of these Marks in any way, shape, or form is absolutely forbidden since access to the Site does not grant the User a license or other right to do so. According to the current laws of India, any breach of the aforementioned would be illegal.

Prohibited Use

• Any other person except the user whose name has been given shall not be allowed to use the services.
• The user shall use the services for which it is subscribed.
• The User agrees to abide by all applicable laws and not violate any Indian laws that may be relevant to the Services, including any regulations imposed in accordance with such laws.
• The User is forbidden from using the Service for any illegal purposes, including but not limited to illegal criminal ones.
• The User shall not transmit or receive any messages that are defamatory on moral, religious, racial, or political grounds or that are derogatory, vulgar, obscene, malicious, or menacing in nature using the Service.
• The User is forbidden from repeatedly sending messages or making posts on (Company Name) to other Users or third parties who access (Company Name) without a valid reason, or for endangering, harassing, annoying, or upsetting anyone.
• It is against the law for the User to present, upload, post, distribute, publish, or transmit any data or software that:
• Enters the Internet or the network system of (Company Name) with a virus, worm, or another dangerous component.
•        Violates a person's intellectual property rights, or with the intent to do so, retains information on a computer system.
• Is prohibited or that could be interpreted as abusive, defamatory, libelous, hurtful, threatening, harassing, vulgar, obscene, or otherwise objectionable due to race, ethnicity, or other factors.
• Is intended to confuse or mislead the other Users
• Violates any copyright, patent, or trademark rights
• According to sanctions laws imposed by the UN, US, UK, EU, or any other Government and/or Regulatory authorities, ETravelMitra does not permit registration or transactions by any member/user who has a direct or indirect connection to any sanctioned countries/territories.

In the event that the User violates any of the aforementioned covenants and the Company learns of the violation, the Company shall have the right to remove any content pertaining to the violations without giving the User prior notice. In the event that the User continues with any activity that results in the aforementioned violations, the Company has the sole authority to terminate or suspend the User's membership at (Company Name) and/or any other related facility. The Company shall issue a warning to the User to cease any activity that results in the aforementioned violations. In addition to the right to indemnity that is available to the Company, the Company shall have the right to pursue any available legal remedies against the User in order to recover the loss that the Company has incurred and the damage done to the Company's goodwill as a result of the User's violation.

Copyright Policy

Any copyrighted content trademarks or other proprietary information may not be posted, distributed, or reproduced in any way without the owner's express written authorization. Without limiting the aforementioned, if you suspect that your work has been duplicated and uploaded on the company service in a manner that violates your copyright, kindly give the following information to our Copyright Agent: a description of the copyrighted work that you claim has been violated; a description of where the material you claim is infringing is located on our site; your address, phone number, and email address; an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a written declaration from you stating that you firmly believe the disputed use is not permitted by the law, the copyright owner, or their agent; a declaration from you, given under oath, that the information in your Notice is true and that you are the copyright owner or have the right to speak on their behalf. As ETravelMitra is an online platform, so the guarantee of confidentiality of any information provided by the users. So, any breach of privacy due to a technical fault or any other means is not the responsibility of ETravelMitra.

Subject to prior identity verification, the User has access to his own data and information that is kept in the database at ETravelMitra and is free to change or alter it whenever he wants.

Users must be informed that their voluntary disclosure of identification-oriented information (name, email address), which results in unsolicited messages from third parties, is outside of their control and outside of the responsibility of ETravelMitra.

Any information that is available to ETravelMitra must be shared in response to any legal procedures, including but not limited to court orders, notices, subpoenas, FIRs, etc.

The Company shall be the single and exclusive owner of all copyrights, know-how, and other relevant intellectual property to the Service or ETravelMitra. The intellectual property of any content the User has provided to ETravelMitra in any way shall instantly become the Company's property, and the User shall have no right or claim to such property. This can be seen as an infringement of the Company's intellectual property, and the Company shall be entitled to legal action in this regard if the User utilizes such intellectual property in any other website or related activity during the term of his agreement or at any time subsequently.

Privacy Policy

Users of ETravelMitra are required to give information in compliance with applicable laws. The information/data submitted by the user may be used by all divisions/sister concerns/ventures of the ETravelMitra to carry out the project's objectives, but it may not be shared with any other company, third party, or entity for any other commercial reason without the user's approval.

You need to write a request for updating, modification, or deletion of the user data. By registering on this site, you agree that the information you post is a public record that can be accessed by other Users of the site. By using this site, the Users understand that all the information provided by you, including but not limited to the company's information, and listing details, is being submitted to the Site. You acknowledge and agree that ETravelMitra may use all the information you submit to assist you in your search for a buyer or seller by either displaying your ad on the Site's search displays for Visitors / Users to see and contact or by forwarding your requirements to registered Users.

ETravelMitra is dedicated to protecting the online privacy of its users and has no plans to disclose, sell, or rent out any of their personal information. In the absence of a legal need or unless it is necessary to facilitate your search, the Site will not transfer any such information. You consent to hold ETravelMitra harmless from any privacy violations caused by technological or other methods.

ETravelMitra is dedicated to providing a safe and secure user experience. The Site pledges to protect your privacy, but it is unable to guarantee or promise this, and you acknowledge that using the Site comes with all associated risks.

Being an intermediary, the Site's function is restricted to giving Users a venue for interaction; we have no influence over how Users who utilize the Site's services use their personal data.

By using the Site's Services, you agree that ETravelMitra may contact you with offers, updates, service-related information, newsletters, feedback requests, surveys, promotions, contests, etc., and that ETravelMitra may collect, store, and use the personal information you provide (including any changes thereto as provided by you) for any of the Services made available by the Site.

The pages on the site make use of "cookies" and other tracking technologies primarily to enhance the user experience, and traffic data is analysed to identify patterns and statistics.

ETravelMitra recommends its users use extreme caution while making purchases online, and it is the user's full duty to confirm and validate both the information on the website and the individuals they choose to connect with. ETravelMitra disclaims any liability for any loss or damage caused by the User's carelessness.

All information that you submit on the Site can only be accessed by you, and it is your obligation to keep it updated. Users are strongly recommended to maintain their profiles and to respect the privacy of other Users. If the website authorities learn that using the Site's services, including updating or deleting a profile, may infringe someone else's rights or if a legal entity requests it, access to those services may be restricted or prohibited.

Limitation of Liability

ETravelMitra is not responsible for any loss or damage of any kind resulting from the use of its services or from the temporary or permanent discontinuation of those services because it only provides a platform to advertise the Tour travel packages and is not involved in any transactions or communications. Regardless of anything in this document to the contrary, ETravelMitra to you for any reason and regardless of the form of the action will always be limited to the amount you paid, if any, to ETravelMitra, for the Service during the membership period.

• ETravelMitra is a public website that provides free access without any liability for the quality and genuineness of the response. ETravelMitra is unable to keep track of the comments that Users make in response to the content that they publish and that is then shown on the website. The user should investigate the legitimacy of each response on their own (s). ETravelMitra disclaims responsibility for any errors in the information on this website.
• ETravelMitra expressly disclaims any responsibility for any harm caused by the presence of any false information on the website.
• The User is advised not to share any personal, sensitive, or confidential information with any former or present employees of the business. The User would act completely at his or her own risk, and the Site or Company would not be responsible for any damages resulting from such a transaction of information, including but not limited to lost earnings or savings, business interruption, loss of information, or damage to one's reputation.
• The User hereby acknowledges full responsibility for conducting adequate research before using any information on the Site. ETravelMitra disclaims all responsibility for any loss or damage of any kind resulting from the use of its services or from the temporary or long-term cessation of such services. Regardless of anything in this document to the contrary, ETravelMitra to you for any reason and regardless of the form of the action will always be limited to the amount you paid, if any, to ETravelMitra, for the Service during the membership period.
• Users may receive free leads from ETravelMitra as part of specific paid packages or special programs, but they may not hold ETravelMitra responsible for the same as this is contingent on availability. These are requests made by customers, and since ETravelMitra has no control over the services, popularity, trends, bundles, season, etc., they cannot be guaranteed. While ETravelMitra will try to transmit leads that meet the users' needs, it is not responsible for the information's correctness or veracity.
• The User acknowledges that certain services that involve Third Party Service Providers, such as Payment Gateway Integration, will only be offered by the User's preferred Third-Party Service Provider, with the role of ETravelMitra being limited to its integration. ETravelMitra is not responsible for any Third-Party Services that are interrupted, delayed, or fail.

Buy Lead Refund

Requests for Buy Leads refunds due to unreachable contact information must be made within five days of the purchase date; otherwise, the request will not be considered.

Since we have no part in regulating the deal closing, transactions, or preferences of the Users, no refund requests resulting from cancelled or fulfilled leads will be entertained.

Website Designing Services

One of the deliverables of some of the Paid Services is website design, and the Site retains the exclusive right to its technical upkeep. Each User hereby agrees to hold the Site/Company, its affiliates, directors, officers, and employees harmless from and against any and all losses, claims, and liabilities (including legal costs on a full indemnity basis) that may result from interruptions caused by Third Party Services, technical errors during uploading, or errors after hosting of the website.

Due to the fact that some Paid Services include a free Website Designing Service, the Site retains the exclusive rights to all technical information, including FTP information. Regarding this, no claim(s) will be taken into consideration. The data of the template-based website is driven by the centralized database of the Site, therefore any attempt to move it to another server would cause it to become inoperable.

Users consent to communication by phone or mail and pledge their complete cooperation in assimilating the information needed for site development. Reminder emails will be sent if users don't return calls or emails, don't send the information or materials needed, don't give the required permissions or feedback on the website's development, don't send the necessary material or photographs, complete the layout, host the website, etc. If the user does not respond after receiving the second reminder email, the website-creating service will be terminated or discontinued in accordance with business policy. Reactivating website design services or requesting changes would only be permitted on a paid basis.

After the development of the website is complete, users will receive a temporary link, and changes will only be accepted if they are sent within the next five days. If no feedback is received after the 5-day period, it will be assumed that you are okay with the site being hosted on the domain.

Following website hosting, any changes would be paid for.

Any exceptions or flexibility in the aforementioned situations would be entirely up to the Site's decision and necessitate a written request from the User.

Disclaimer

• Regarding the Services and the accuracy or quality of any information communicated or gained through the Services of ETravelMitra, the Company makes no representations or warranties of any kind, either express or implied.
• In no circumstances may the Company's responsibility under this Agreement exceed the sum of all fees and charges paid by the User to the Company during the two (2) month period immediately previous to the incident giving rise to the applicable claim.
• The Company shall not be liable for any loss or damages resulting from any disclosure of information pertaining to the User's account and details, whether intentionally or unintentionally, or for any error, omission, or inaccuracy with regard to any information so disclosed.
• The Company makes no promises or warranties regarding the qualifications, standing, or authenticity of any tour travel agent, tour operator, hotel, etc. that contacts Users after seeing the information/data submitted by Users.
• The Company does not guarantee that ETravelMitra or any of the websites connected to by ETravelMitra will operate without interruption or be free of viruses, worms, or other harmful elements.
• The User recognises that it is not the Company's policy to exert editorial control over, edit or change any data or contents of any emails or postings, or to add, make available, or transmit to a third party, any information that may be included in, made available, or transmitted in or through us. Any artwork, materials, information, or content of any data or information or posting may be refused, suspended, terminated, deleted, or amended by the Company if it believes that doing so will enable it to comply with its legal or moral obligations and will prevent it from violating the rights of others or any other rules, standards, or codes of conduct that may be applicable to the posting or the website or the internet.
• The User is solely in charge of verifying the veracity of each and every response, query, and piece of information shown. Since it is a public website with open access, ETravelMitra disclaims all responsibility for the accuracy and sincerity of responses.
• The users are responsible for testing, analysing, and independently verifying the qualifications of any potential tour travel agent, tour operator, or user that has been approached by the website.
• The user-supplied data may be changed by the user alone and is completely their responsibility, so the company or the website is not liable for the information's current state.
• The User is responsible for making sure that while using the Service, all currently in effect and applicable laws, rules, and regulations, whether directly or indirectly related to the use of systems, services, or equipment, are strictly followed by the User at all times. The Company shall in no way be held responsible for the User's failure to comply with any such laws, rules, or regulations.
• The site is controlled and run from India, and it makes no claims that the content is suitable or will be made available for use anywhere else in the world. If you access this site from a country other than India, you are solely responsible for adhering to all local laws and treaties that may be in force there.
• It is strongly encouraged for users to independently confirm the validity of any Pre-Launch offers they may have received. Users who deal in such projects do so totally at their own risk and responsibility. The site does not support investing in any projects that have not been officially sanctioned and launched by the builder or promoter.

Use of Data

• The User hereby grants the Company the following unrestricted rights and licenses: To use any data and information provided by the User in connection with this Agreement for the Company's own purposes; to share such data and information with any associated companies or carefully chosen third parties, including search engines.
• Use any information provided by the user to send offers or emails about specific services; these emails must not be construed or declared to be an unsolicited communication.
• Despite the termination or suspension of the Service to the User hereof, let all data and information provided by the User in using the Service remain at (Company Name) for the use of the Company in line with the service agreement with the User. Following the termination or suspension of the Service for the User, such data and information remain in the Company's property, records, and databases unless the User instructs the Company to remove all such data and information.

Indemnity

You agree to defend, indemnify, and hold harmless (Company Name), its subsidiaries, affiliates, officers, agents, and other partners and employees from any loss, liability, claim, or demand made by a third party due to or arising from your use of the Service in violation of this Agreement, a breach of these Terms of Use, or any breach of the representations and warranties you made above. This includes reasonable attorney's fees.

Variation

The User will get notice of any changes (in the manner the Company may choose) to the terms and conditions included here and in the Services Guide at any time.

The terms and conditions of this contract will occasionally be changed and posted at ETravelMitra. To review the Terms and Conditions, the User should periodically visit the website. The User's continued use of the Service after the terms and conditions have been changed constitutes an affirmation and recognition of the revised terms and conditions, for the avoidance of doubt.

Payment and Refund Policy

Only payments made to "ETravelMitra " may be used to cover services rendered at the website. We haven't given anyone the go-ahead to accept payments for any of our services under any other names (i.e., any other names for people or organizations), or through personal Western Union or personal PayPal accounts of ETravelMitra. You should be aware that ETravelMitra will never be held responsible for any harm you may do to such dishonest people or businesses.

In the event that any such dishonest person or business tries to deceive you, please get in touch with us very away so that we can safeguard your interests.

For uninterrupted use of Paid Services, all payments must be made in full advance. The User shall be solely responsible for carrying out any online or offline transaction involving credit cards, debit cards, or other forms of instruments or documents for making such transactions. The User shall be solely responsible for maintaining confidentiality, all activities, and transmission performed through his My Folder. ETravelMitra disclaims all liability and responsibility for any improper use of the subscriber's credit or debit card information, whether that usage occurs online or off.

There is no option for any form of full or partial refund because we maintain close relationships with our customers and offer encouragement to use the services offered at ETravelMitra. The paid sum will not, under any circumstances, be refunded, as it is explicitly stated.

Orders placed online cannot be changed because they are processed and activated right away. You cannot request a refund or chargeback because your personal preferences changed over time.

Even if the User challenges the Subscription Fees for whatever reason, the User is nevertheless required to pay them immediately upon demand. If the Company decides the dispute is in the User's favour, the Company will give the User a refund for any extra money they paid, interest-free. The Membership and the Services shall terminate in the case of late payment by the User of any amounts owing under this Agreement.

Suspension or Termination of Services

We reserve the right to completely terminate a User's Account at any time without providing the User (Free and Paid Members) with a justification or prior notice in order to protect the interests of other Users of ETravelMitra and/or the rights of third parties of ETravelMitra. In accordance with the company, termination or suspension, either in full or in part, may be based on reasonable suspicion, upon receipt of a complaint, upon a belief, upon an investigation, or upon notification from governing bodies or law-making bodies, and may be done for the following reasons:

a)      If there is any breach in the provisions of this Agreement by the Users.

b)     If the wrong or incomplete information is provided by the users or if the users unlawfully use another person or business entity name. Or they impersonate another person or business identity in any manner.

c)      If the user's conduct could expose other users, ETravelMitra, or its affiliates to financial harm or legal liability.

d)     If the User(s) is/are using the Services in an unauthorized, dishonest, or improper manner or engaging in conversations, activities, or transactions that are unlawful, forbidden, or inappropriate.

e)     If the user(s) submits anything that has nothing to do with the site's services or spams the site in any way

f)       If the User(s) are engaged in activities that include unauthorized access to, use of, modification of, or control of the database, network, or services connected to the Site.

g)      If the user(s) accesses another user's account by using the username and/or password of another registered user(s).

h)     If the User(s) violates another person's or company's intellectual property rights.

i)       If the user's activity is not as per the ethics and honest business.

After such termination, the User(s) would no longer be able to access the Site's free and paid services, and they would also not be able to register again with new user information unless ETravelMitra specifically authorized it in writing. In the event of termination, no membership fees or subscription costs paid by the User(s) will be reimbursed. The User(s) understand and concur that any direct or indirect losses resulting from such termination are not the responsibility of the User(s) of ETravelMitra.

User Disputes

Your interactions with other users at the ETravelMitra Website are exclusively your responsibility, and the website reserves the right but is under no duty to, keep an eye on Member disputes.

In relation to any transactions made over the Site, ETravelMitra will not participate in any legal proceedings between the User and any other registered or unregistered Users. Although ETravelMitra will always comply with governmental or legal authorities' orders and completely collaborate throughout the process, the costs of doing so must be paid for by the person or entity who has implicated ETravelMitra in such a matter.

Matter of Disputes and Jurisdiction Aspects
